1. Introduction & Acceptance

By accessing studio.graphtics.in, submitting a project brief, or purchasing from our store (store.graphtics.io), you agree to adhere to these Terms. If you do not agree to these terms, please discontinue use of our services immediately.

2. Description of Services

Graphtics operates as a hybrid creative entity:

• Studio Services: Custom 2D/3D artwork, branding, web development, music production, and freelance project management.
• Physical Store: Sale of physical goods including 3D printed items, canvas paintings, and handmade portraits.

3. Digital Studio: Payment & Compensation

To ensure operational continuity and fair compensation for our talent, Graphtics operates on a strict 3-Stage Payment Structure:

3.1 The 50/25/25 Protocol

• Initiation (50%): Due in advance to book talent and begin research. Non-refundable after 24 hours.
• Mid-Point (25%): Due upon presentation of Initial Concepts (Half Stage). Unlocks refinement phase.
• Completion (25%): Due prior to the final submission of high-resolution deliverables.

Payments are facilitated via secure gateways (Razorpay, PayPal, Stripe). Delinquency in payments (overdue >15 days) may result in a temporary suspension of services.

4. Intellectual Property (IP) Rights

We believe in empowering our clients. Unlike traditional agencies that hoard rights, we transfer ownership upon completion.

4.1 Client Ownership

Upon full settlement of all three payment tranches, the Client is granted 100% Exclusive, Perpetual, Worldwide Rights to the Final Deliverables. You own the files, the designs, and the commercial rights.

4.2 Studio Rights

Graphtics retains the right to display the work in our portfolio, case studies, and marketing materials unless a specific Non-Disclosure Agreement (NDA) is executed prior to the project start.

5. Revisions & Refinement

Your satisfaction is paramount. Our revision policy is designed to be generous yet structured:

• Standard Phase: Includes two (2) rounds of revisions per milestone during active production.
• Post-Delivery (7-Day Window): We provide 3 complimentary revisions within 7 days of final delivery for minor tweaks.
• Paid Revisions: Any 4th revision request, or any request made after the 7-day window, will be billed as a Change Order at standard hourly rates.

6. Confidentiality Commitment

Acknowledging the sensitivity of project-specific details, both Graphtics and the Client agree to uphold a stringent confidentiality agreement. We will safeguard your private information and trade secrets for a period of 2 Years after the project's completion.

7. Termination & Cancellation

Either party may terminate the project with written notice. Cancellation fees apply based on the stage of work completed:

• 0-24 Hours: Full Refund.
• Pre-Work: 20% Cancellation Fee.
• Mid-Production: 80% Cancellation Fee (Labor coverage).

8. Physical Products (Store Terms)

The following terms apply specifically to purchases made via store.graphtics.io:

8.1 Product Accuracy

We strive to ensure all product descriptions and prices are accurate. If an error is discovered in an order you have placed, we will offer the option to reconfirm at the correct price or cancel. If we cannot contact you, the order will be treated as canceled.

8.2 Warranty & Defects

All physical products are covered by a 3-Month Warranty against manufacturing defects. If you discover a defect, contact support@graphtics.in for a repair, replacement, or refund.

9. Limitation of Liability

Graphtics provides its services "as is." We expressly disclaim liability for any indirect, incidental, or consequential damages ensuing from our Services. Our aggregate liability is confined exclusively to the fee amount paid for the particular project in question.

10. Governing Law

These Terms shall be governed and construed in accordance with the legal provisions of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in India.

11. Modifications to Terms

Graphtics reserves the right to update these Terms periodically. Substantial revisions will be communicated via email or website notice at least 30 days before taking effect.
